These Terms and Conditions govern the provision of roadside battery assistance and battery fitting services ("Services") offered by My Battery Plus. By requesting and/or using these Services, you agree to be bound by these Terms and Conditions.

  1. Service Availability 2.1. The Services are available to customers within our designated service areas during specified operating hours, which may be subject to change without prior notice. 2.2. My Battery Plus reserves the right to refuse service to any individual or vehicle at its sole discretion.

  2. Service Requests 2.1. Service requests must be made through the designated My Battery Plus contact channels. 2.2. When requesting service, you must provide accurate and complete information about your location, vehicle type, and the nature of the issue. 2.3. My Battery Plus will make reasonable efforts to respond to service requests promptly, but response times may vary depending on factors such as traffic, weather conditions, and service demand.

  3. Roadside Battery Assistance 3.1. Our roadside battery assistance service includes battery testing, jump-starting, and the provision of a temporary battery if necessary. 3.2. In the event that our technician determines that a replacement battery is required, you may purchase one from My Battery Plus, subject to availability and compatibility with your vehicle.

  4. Battery Fitting 4.1. My Battery Plus will fit the replacement battery in your vehicle, provided that it is safe and feasible to do so at your location. 4.2. Our technicians will take reasonable care when fitting batteries, but My Battery Plus will not be liable for any damage to your vehicle or other property resulting from the fitting process, except in cases of gross negligence or willful misconduct.

  5. Service Limitations 5.1. My Battery Plus may be unable to provide Services in certain situations, including but not limited to: unsafe or inaccessible locations, extreme weather conditions, insufficient information about your location or vehicle, or lack of necessary equipment or resources. 5.2. In such cases, My Battery Plus will not be liable for any loss or damage arising from the unavailability of Services.

  6. Payment 6.1. Payment for Services, including any replacement batteries, must be made at the time of service. 6.2. Payment can be made using accepted credit or debit cards or other approved methods. My Battery Plus reserves the right to refuse service if payment cannot be verified or processed.

  7. Liability 7.1. To the maximum extent permitted by law, My Battery Plus will not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to loss of use, loss of profits, or loss of data, arising from the use of or inability to use the Services. 7.2. Nothing in these Terms and Conditions is intended to limit or exclude any rights you may have under the Australian Consumer Law or other applicable legislation.

Changes to Terms and Conditions My Battery Plus reserves the right to modify these Terms and Conditions at any time without notice. Your continued use of the Services following any changes constitutes your acceptance of the updated Terms and Conditions.

Governing Law These Terms and Conditions are governed by the laws of Australia, and any disputes arising from or related to the Services shall be subject to the exclusive jurisdiction of the courts of Australia.
